67-6610C - USE OF CONTRIBUTIONS FOR CERTAIN PURPOSES BY CANDIDATE OR OFFICEHOLDER
USE OF CONTRIBUTIONS FOR CERTAIN PURPOSES BY CANDIDATE OR
OFFICEHOLDER. Amounts received by a candidate as contributions that are in
excess of any amount necessary to defray his expenditures may be used by the
candidate as follows:
(1) For any lawful purpose, including transfers without limitation to any
national, state or local committee of any political party or to an
organization that is exempt from taxation under section 501(c)(3), 501(c)(4),
501(c)(6), 501(c)(8), 501(c)(10), 501(c)(19) or 501(d) of the Internal Revenue
Code and is exempt from income taxation under title 63, Idaho Code, as a bona
fide nonprofit charitable, civic, religious, fraternal, patriotic or veterans
organization or as a nonprofit volunteer fire department, or as a nonprofit
volunteer rescue squad, or as a nonprofit volunteer educational booster group,
parent-teacher organization or association;
(2) For any ordinary and necessary expenses associated with any public
office the candidate may hold. No funds other than contributions regulated
under this chapter shall be used pursuant to this section. No contributions
shall be converted to any personal use. For the purpose of this section, a
contribution shall be considered to be converted to personal use if the
contribution is used to fulfill any commitment, obligation, or expense of a
person that would exist irrespective of the candidate's election campaign or
the individual's duties as a holder of public office.
